1) CONTEST/SUBMISSION PERIOD: The Dunkin’ Donuts Chance for StarDDom Contest (the “Contest”) begins on 9/29/11 at 12:00:00 a.m. ET and ends on 10/20/11 at 11:59:59 p.m. ET (the “Submission Period”). The Webmaster’s computer will be the official time keeping device of this Contest. The Contest Judging and Voting Phases (and criteria) are further detailed in section 6 below.
2) CONTEST DESCRIPTION: The object of the Contest is to visit the Chance for StarDDom Contest Application (the “Contest Application”), which can be found by following the link from the Dunkin’ Donuts Facebook Page, and to submit a photo of yourself, along with a caption of up to one hundred (100) words, representing and explaining why you are the biggest Dunkin’ Donuts coffee fan (together an “entry”). All entries must comply with these Official Rules and meet the submission guidelines (“Submission Guidelines”) herein. All entries will be judged upon in accordance with the judging criteria (“Judging Criteria”) detailed below, and all entries will be voted upon in accordance with who the public thinks is the biggest Dunkin’ Donuts coffee fan. This Contest is in no way sponsored, endorsed, administered by, or associated with Facebook and entrants hereby release Facebook from any liability in connection with this Contest. By entering, entrants understand they are submitting their information to Sponsor, and not to Facebook, and agree to look solely to Sponsor with any comments or issues.
3) ELIGIBILITY: The Contest is open only to permanent legal residents of the fifty (50) United States (including the District of Columbia), who are eighteen (18) years of age or older, or the age of majority in their jurisdiction of residence, whichever is greater, as of the date of their entry. Employees, directors and officers of Dunkin’ Brands Inc. LLC (“Sponsor”), Bottlerocket Marketing Group, LLC (“Administrator”), and any of their respective affiliates, franchisees, parents, subsidiary companies, and advertising and Promotion agencies (collectively the “Released Parties”), employees, directors and officers of Dunkin' Donuts franchisees, and members of the immediate families (spouses, parents, children, and siblings and their respective spouses, regardless of where they reside), and/or those living in the same household of any of the foregoing are not eligible. Void in Puerto Rico and everywhere else outside the U.S. and where prohibited, or otherwise restricted by law. Subject to all federal, state and local laws. This Contest and any advertisements relating thereto are intended for viewing only within the fifty (50) United States and the District of Columbia. By participating in the Contest, you agree that: (1) you have read and understand the Official Rules; (2) you meet the Contest eligibility requirements as explained in the Official Rules; (3) you are bound by the Official Rules and to Sponsor's Conditions of Use, Legal Notices and Privacy Policy as published at www.DunkinDonuts.com; (4) you unconditionally accept and agree to comply with and abide by the Official Rules and the decisions of Sponsor, whose decisions shall be final and binding in all respects.
4) HOW TO ENTER: NO PURCHASE IS NECESSARY TO ENTER OR WIN, and no entry fee or payment is necessary to participate in the Contest. You must become a fan of Dunkin’ Donuts on Facebook in order to be eligible to enter. Each person/entrant is solely responsible for any and all uses of his/her registered account. Entrants should make best efforts to be the only human being who is identifiable in the submission. In the event Sponsor determines, in its sole discretion, that another human being is identifiable in the submission, such person(s) (or such person’(s) parent or legal guardian if they are not 18+ years of age or of the age of majority in their jurisdiction) is/are required to sign the participation release document (“Participation Release”), which is available at the bottom of this set of Official Rules. Sponsor reserves the right to request proofs of these signed Participation Release documents at any point in time, and such documents may be required in order to be deemed an official winner of a prize. Failure to provide said proof may result in disqualification of the entry from the Contest. All entries must comply with these Official Rules and meet the submission guidelines (“Submission Guidelines”) detailed herein. Proof of submission of entry does not constitute proof of delivery or entry. Entries will not be returned to entrants.
To enter the Contest, entrants must visit the Contest Application and follow the onscreen directions to complete the registration process and upload and submit their entry in compliance with these Official Rules and the Submission Guidelines. Incomplete entries or entries that do not fully comply with these Official Rules and the Submission Guidelines, in the sole discretion of Sponsor, will not be eligible. Entrants may submit as many entries as they want, so long as each entry is unique from their previous entry and/or the entries of others. If an entry includes private third party property or places, entrant hereby represents and warrants he/she has received express permission from such private third party property or place owner to submit such entry, and Sponsor may request proof of such express permission in written form at any time. Failure to provide the above referenced proofs may result in disqualification of the entry from the Contest.
Each time an entrant submits an eligible entry into the Contest, such entry will be entered into the Contest, which will utilize a combination of judging and consumer voting in order to select one (1) potential Grand Prize winner and ten (10) potential First Prize winners.
5) SUBMISSION GUIDELINES: Each entry that is submitted to the Contest must comply with these Official Rules and all entries must comply with the following Submission Guidelines. Any entry that, in Sponsor’s sole and absolute discretion, violates these Official Rules or the Submission Guidelines below will be disqualified. Entry is not complete until the submission has been moderated, approved and then posted live by Sponsor or Administrator, whose decisions are final and binding with all respects to this Contest. By submitting an entry, entrant and any other identifiable person grants Sponsor permission to use his/her entry, name, likeness, hometown, photograph or image for future advertising and publicity purposes in connection with this Contest or other marketing efforts in any and all media, without additional compensation, notification or permission, unless restricted by law.
The entry must, in Sponsor’s sole discretion:
• Not exceed 5 MB and must be submitted in one of the following Photo formats: .jpeg or .gif
• Be entrant’s original creation and must not have been copied, in whole or in part, from any other work
The entry must NOT, in Sponsor’s sole discretion:
• Have been previously published
• Have previously won any prizes in a Contest of any kind
• Contain material that, in the sole discretion of Sponsor:
o Disparages any person, Sponsor and/or any of its affiliates’ products, competitors, or any of the Released Parties affiliated with sponsoring, promoting or administering this Contest, or other companies;
o Violates or infringes upon the copyrights, trademarks, or privacy, property, publicity or other intellectual property rights of any person or entity;
o Includes brand names, copyrighted work or trademarks/logos that may infringe on rights of any third party. The entry may include Dunkin’ Donuts brand name, copyrighted works or trademarks/logos, which entrant is hereby granted a limited license to use solely for the purpose of creating and submitting an entry to this Contest.
o Appears to duplicate any other submitted entries;
o Is hateful, tortuous, defamatory, slanderous or libelous;
o Promotes bigotry, racism, sexism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
o Contains any personal identification, such as personal names, phone numbers or e-mail addresses, without permission;
o Contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
o Contains look-alikes of celebrities or other public or private figures, living or dead, without permission;
o Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);
o Promotes any activities that may appear unsafe or dangerous;
o Is unlawful or in violation of any law;
o Contains any nudity, sexually explicit, lewd, offensive, disparaging or other inappropriate content;
o Is unsuitable to be entered into this Contest for any reason whatsoever, at Sponsor’s sole discretion; and/or
o Communicates messages or images inconsistent with the positive images and/or good will to which Sponsor and/or the Released Parties wish to associate, in Sponsor’s sole discretion.
As a condition of entering the Contest, each entrant warrants and represents that he/she is the/an individual appearing in or represented in the entry and that the entry does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Entrant agrees that the Released Parties are not responsible for any unauthorized use of entries by third parties. Released Parties do not guarantee the posting of any entry and any/all posting is in their sole discretion. At any time during the Contest, even if the entry is already posted on the Contest Application or is being taken into consideration for a prize, if Sponsor determines that an entry is not in compliance with any of the Submission Requirements or these Official Rules, the entry will be disqualified and will not be eligible to win a prize. Entrants agree that they will not use the entry for any other purpose, including, without limitation, posting the entry to any other online social networks, without the consent of Sponsor.
6) CONTEST JUDGING AND VOTING PHASES/CONTEST PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): After the Submission Period has ended, as detailed in the chart below, there will be a Contest Voting/Judging Period (“Voting/Judging Period”).

Voting: During the Voting/Judging Period, all entries that comply with these Official Rules and the Submission Guidelines, in Sponsor’s sole discretion, will be viewable on the Contest Application. Throughout the Voting/Judging Period, the public will have the opportunity to vote, utilizing a “Vote” button, by accessing the Contest Application and following the voting instructions. The public should cast their vote(s) according to who they think is the biggest Dunkin’ Donuts coffee fan. You do not have to be registered to the Promotion or submit an entry in order to cast a vote. However, you will be required to allow access and “like” the page in order to cast a vote. VOTE LIMIT: one vote per person, per day, regardless of email address or account used. At the end of the Contest Voting/Judging Period, public voting shall count for twenty-five percent (25%) of each entrant’s final score, with judging counting for the remaining seventy-five percent (75%) of the final score, which will determine the top eleven (11) entries. Each entry will be assigned a score of 2.5% - 25% based on how many votes it received, relative to the competition (e.g. top 10% of vote getters will receive a full 25% score, the next 10% will receive a 22.5% score…). In the event of a tie between two or more entries, Sponsor will make the final determination by utilizing “judging criteria (A)” below as a tie-breaking device, in its sole discretion. All votes must be submitted during the Voting/Judging Period. The use of robotic or automatic devices for voting is prohibited. Votes generated by script, macro, or other automated means, or with the intent to impair the integrity of the voting process will be void and Sponsor reserves the right to nullify all such votes and to disqualify from voting the responsible individual.
Judging: At the same time public voting is taking place during the Voting/Judging Period, Sponsor representative(s) who are qualified to judge in such fields (the “judge(s)”) will judge all eligible entries based on the following criteria: A) 40% - Passion For Dunkin’ Donuts Coffee; B) 30% - Overall Appeal; and C) 30% - Originality/Creativity.” Utilizing these criteria, the judge(s) will assign a percentage score to each entry. This percentage score will count for seventy-five percent (75%) of the entrant’s final score with public voting counting for the remaining twenty-five percent (25%).
Contest Prizes:
The combination of the judging percentage score and the public voting percentage score will determine each entrant’s final tally and will determine the top eleven (11) entries. In the event of a tie after the judge’s scores have been tabulated, tied entries will be re-judged by the judges based solely on “judging criteria (A).” Once the top eleven (11) entries are determined as detailed above, the Judges will then select one (1) Grand Prize winner from those top eleven (11), utilizing the criteria (and tie break method if necessary) detailed above as well as Sponsor’s overall determination of who is Dunkin’ Donuts biggest coffee fan, and the remaining ten (10) entries will be deemed the First Prize winners. Judge’s and Sponsor’s decisions are final with respect to all matters relating to the Contest.
Grand Prize – The one (1) Grand Prize winner will receive a prize package containing the following elements: (a) Free Dunkin’ Donuts coffee for one (1) year, awarded in the form of two pounds (2lbs) of ground coffee sent to the Grand Prize winner’s address each month for twelve (12) months; and (b) The opportunity to be featured in a Dunkin’ Donuts advertisement (exact specifics of the advertisement (print, online, TV, etc…) and the Grand Prize winners featured portion therein will be at the sole discretion of Sponsor) If necessary, Sponsor will provide round-trip coach class air transportation for the Grand Prize winner from a major U.S. airport nearest to winner’s home (as determined by Sponsor), to a major U.S. airport nearest determined location (as determined by Sponsor); one (1) night standard hotel accommodations at a hotel of Sponsor’s selection; and ground transportation to/from the airport in the determined location to the hotel of Sponsor’s discretion and to/from the location the advertisement will be created. ARV of the Grand Prize is between Two Hundred Dollars and Two Thousand Dollars ($200 - $2,000), depending on if travel is required, the duration of the travel, and the location of the Grand Prize winner’s residence. The Grand Prize winner must be available to appear and/or travel to the ad appearance between January 1, 2012 and January 31, 2012, at Sponsor’s discretion.
First Prize(s) - The ten (10) First Prize winners will each receive free Dunkin’ Donuts coffee for one (1) year, awarded in the form of two pounds (2lbs) of ground coffee sent to each First Prize winner’s address each month for twelve (12) months. ARV of each First Prize is Two Hundred Dollars ($200).
7) GENERAL: Total ARV of all prizes in the Contest is between Two Thousand Dollars and Four Thousand Four Hundred Dollars ($2,000 - $4,400), depending on the final dollar amount for the Grand Prize. All Grand Prize details, including but not limited to selection of ad creation destination and dates, are at Sponsor’s sole discretion. Grand Prize is currently scheduled to be fulfilled between 1/1/12 and 1/31/12, but is subject to change. Grand Prize winner may be required to spend additional time at location, at Sponsor’s expense. Grand Prize winner may receive less than thirty (30) days notice prior to trip departure, if necessary. If advertisement is cancelled or rescheduled, if for any reason Sponsor is unable to provide the Grand Prize winner placement in the advertisement, or if Grand Prize winner is not able to travel on dates, or remain for the duration specified by Sponsor, Sponsor shall have no further obligation to Grand Prize winner other than to supply the Grand Prize winner with one (1) year, awarded in the form of two pounds (2lbs) of ground coffee sent to the Grand Prize winner’s address each month for twelve (12) months and then Sponsor’s obligations to the Grand Prize winner will be fulfilled and no additional compensation shall be due to the Grand Prize winner. Sponsor may require that Grand Prize winner sign additional documents relating to his/her participation in the advertisement. The Sponsor cannot guarantee that if the Grand Prize winner participates in the creation of the advertisement, that the Grand Prize winner’s featured portion will make the final cut of the advertisement. Except as determined by the Sponsor in its sole discretion, no substitution of any prize shall be offered and no transfer of any prize to a third party is permitted. All federal, state, and other tax liabilities arising from this Contest are the sole responsibility of the applicable prize winner. The prizes are not redeemable for cash. No more than the stated number and value of prizes listed in these Official Rules will be awarded. Actual value of the Grand Prize depends on if travel is involved and the city of departure, time of travel, any airfare fluctuations and on current market conditions at time of prize fulfillment, and any difference between the stated ARV and the actual value, if any, will not be awarded. Travel arrangements, if necessary, will be made through the travel coordinator designated by Sponsor. One or more stopovers may be required on any air transportation. Sponsor will not replace any lost or stolen tickets, travel vouchers, certificates or similar items once they are in Grand Prize winner's possession. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. If any portion of the Grand Prize is unable to take place as planned, for any reason, including but not limited to, cancellation, scheduling conflicts or an event of force majeure, the remaining components of the Grand Prize will be awarded and Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. Grand Prize conditions may be added or modified by companies providing those portions of the prize. The Grand Prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the affidavit and release and/or prize travel documents. If travel is involved, Sponsor shall not be liable for any loss or damage to baggage. Sponsor reserves the right to substitute ground transportation for air transportation if the Grand Prize winner lives within a reasonable distance, at Sponsor’s discretion, to the selected destination where the advertisement will be created. Grand Prize winner is solely responsible for obtaining all necessary and required travel documents and receiving all necessary vaccinations (passport, ID, shots, etc.). All airline tickets issued in conjunction with prize are not eligible for frequent flyer miles, and no code-share flights may be used. Prize components cannot be used in conjunction with any other Contest or offer, and no portion may be separated except at Sponsor's sole discretion. Grand Prize winner must have a valid U.S. photo identification and credit card in his/her name. Grand Prize travel, if any, does not include insurance, telephone charges, personal expenses, meals, gratuities, incidental charges, taxes, or any other items not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the Grand Prize winner. Sponsor may choose to award fewer than one (1) Grand Prize and Ten (10) First Prizes if, in its sole discretion, it does not receive enough eligible and qualified entries. In the event of a dispute, an entry will be declared/made by the authorized account holder of the email address submitted at the time of entry, and if a prize is won, it will be awarded to such email account owner, or to the parent of such email account owner if such account owner is a minor in his/her jurisdiction. “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet Access Provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her e-mail, phone number or postal address during or shortly after the Contest Submission Period. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
10) WINNER NOTIFICATION/CONFIRMATION: No potential Grand Prize or First Prize winner is an official winner unless and until Sponsor confirms such. The potential Grand Prize winner will be notified via telephone and/or email, in accordance with the contact information provided at the time of entry, on or about 11/22/11. Sponsor will make two (2) attempts, two (2) days apart, to contact the potential Grand Prize winner via such methods. Potential Grand Prize winner will have four (4) calendar days from the time of the first notification attempt to respond to Sponsor or else Sponsor will move on and notify an alternate Grand Prize winner. Once contact is made, potential Grand Prize winner will be required to sign and return to Sponsor an Affidavit of Acceptance, Eligibility and Liability/Publicity Release (where lawful), and may be required to sign an assignment of copyrights and/or other rights in favor of the Sponsor (collectively the “Prize Claim Documents”). Grand Prize winner will receive an IRS 1099 Form at the end of the tax year in which they receive the Grand Prize if the Grand Prize involves travel and is then a value of over six hundred dollars ($600). Sponsor, or its representative, must receive all Prize Claim Documents by the due date indicated during the notification correspondence, or on the Prize Claim Documents. If potential Grand Prize winner fails to respond in the time period specified above, if any Prize Claim Documents are not returned within the number of days specified, if any notification or notification attempt is returned as undeliverable or as an error, or the potential Grand Prize winner declines their prize, then the prize may be forfeited and an alternate winner will be selected, at the Sponsor’s sole discretion. Potential First Prize winners may be contacted via telephone and/or email, in accordance with the contact information provided at the time of entry, and may be required to confirm their address before delivery of such prize, or Sponsor/Administrator may simply mail such prize to the potential winner at the contact information provided. Potential First Prize winners may be required to sign an assignment of copyrights and other rights in favor of the Sponsor. If any notification attempt or prize delivery fails or is returned for any reason, such potential winner may forfeit the prize, and Sponsor will select an alternate potential winner.
11) REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION: Each entrant represents and warrants he/she has not engaged or taken part in (or induced or encouraged anyone else to do so) any activity or conduct in connection with this Contest that may or is likely to harm or create a risk of harm, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to any person, other living things or any property; may or is likely to create a risk of any other loss or damage to any person, living things or any property; is or may constitute a crime, unlawful or non-consensual activity (e.g., conduct that could lead to criminal prosecution), tortuous conduct (e.g., conduct that could lead to civil prosecution). Each entrant hereby agrees to indemnify and hold the Released Parties harmless from and against any and all claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating, in whole or in part, directly or indirectly, to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder. Failure of Sponsor to enforce any provision herein shall not be deemed a waiver of such.
12) GRANT OF RIGHTS/INTELLECTUAL PROPERTY: Each entrant grants to Sponsor a royalty free, irrevocable, fully paid, perpetual, non-exclusive and unrestricted license in each entry to display and use the entry as Sponsor determines now and in the future and to publish, adapt, edit and/or modify their entry in any way, in whole or in part, and to use such entry in commerce and in any and all media now known or hereafter discovered, worldwide, including but not limited to the Contest Application, without limitation or compensation to entrant and without right of notice, review, or approval of any such use of the entry. Any entrant whose work includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to depictions of buildings, trademarks, persons or logos) must be able to provide, upon Sponsor’s or Administrator’s request, legal releases authorizing such use in the entry in Sponsor’s and Sponsor’s designees’ advertising, marketing and Contests in any and all media, in perpetuity, without additional compensation, permission, or notification, unless prohibited by law. Failure to provide such releases upon request may result in disqualification. By entering, you hereby indemnify and hold harmless the Released Parties from any claims and damages (including reasonable attorneys’ fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, your entry, or your conduct in creating your entry, or otherwise in connection with this Contest. Sponsor respects the rights of others. The Contest Application may contain materials of third parties and Sponsor may also transmit and store such third party materials. As a result, materials of third parties, not owned or controlled by Sponsor, may be included on the Contest Application or may be stored or transmitted over Sponsor’s digital online communication systems. To the best of Sponsor and Administrator’s knowledge, these materials do not infringe on the rights of others. Upon receipt of proper notice of claimed infringement, Sponsor and/or Administrator will respond expeditiously to resolve the claim between the notifying party and the alleged infringer who provided the materials in issue, including, where applicable, removing or disabling access to materials claimed to be infringing. The proper party whom you should address such notice is StarDDom@bottlerocketmarketing.net.
13) PRIVACY: Except as otherwise stated in these Official Rules, any personal information collected in connection with this Contest will be used in accordance with the Sponsor’s Privacy Policy found at Home | Dunkin' Donuts and with any other consent given by an entrant. Participation in this Contest constitutes consent to said Privacy Policy. Any communication or information transmitted to Sponsor and/or the Contest Application by electronic mail or otherwise is and will be treated as non-confidential and non-proprietary.
14) OTHER CONDITIONS: Entrants agree that the Released Parties (a) shall not be responsible or liable for any losses, damages or injuries of any kind resulting, in whole or in part, directly or indirectly, from participation in the Contest or any Contest-related activity, from acceptance, receipt, possession and/or use or misuse of a prize (including any travel or activity related thereto) or any Contest Entity’s use of any entry or the rights granted herein, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to a prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Released Parties assume no responsibility for computer system, Contest Application, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or networks, server, cable, satellite, Internet Service Provider (ISP) or other connections that are human or technical in nature or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging/voting on entries, the notification and announcement of the winners, the incorrect uploading of any entry or in any other Contest-related materials. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part, for any reason, including should virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes corrupt the administration, security, fairness, integrity or proper play of the Contest, or any part of it. Released Parties are not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest, by any technical or human errors which may occur in the processing of the entries in the Contest. In the event of termination or cancellation, Sponsor reserves the right award the prizes from among all eligible, non-suspect, entries received prior to the date of the termination or cancellation using the judging criteria outlined above or a random drawing method, at the sole discretion of Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or Contest Application, or to be acting in a unsportsmanlike or disruptive manner or in violation of these Official Rules. Released Parties are not responsible for entries that are late, tampered with, forged, incomplete, misdirected, lost, misplaced, stolen, delayed, garbled, damaged, inaccurate, undelivered, destroyed or otherwise not in compliance with these Official Rules, and all such entries will be void. Sponsor reserves the right at its sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of the Contest; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. All prizes are awarded “AS IS” and without warranty of any kind, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. Any and all guarantees and warrantees on merchandise prizes are subject to the manufacturer’s terms and conditions and winners agree to look solely to said manufacturers for any such warranty or guarantee claim. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE CONTEST APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
15) IDEA SUBMISSIONS: As a condition of submitting an entry, each entrant acknowledges and agrees that (a) Sponsor and other participants have access to and/or may create or have created entries and/or other materials, ideas and concepts which may be similar or identical to the entrant’s entry in theme, idea, format, characters and/or other respects; (b) the entrant will not be entitled to any compensation or other consideration because of the use by Sponsor or any other participant of any such similar or identical material, ideas and/or concepts; and (c) Sponsor’s or another participant’s use of material containing elements similar to or identical with those contained in the entrant’s entry shall not obligate Sponsor to negotiate with and shall not entitle entrant to any compensation or other claim.
16. DISPUTES: THE CONTEST IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
17. NO OBLIGATION TO USE: Sponsor shall have no obligation (express or implied) to post any entry to the Contest Application, to approve any entry, or to otherwise exploit any entry. Further, if commenced, Sponsor has no obligation to continue the posting, distribution, or exploitation thereof, and Sponsor may at any time abandon the use of any entry for any reason, with or without legal justification or excuse, and entrants shall not be entitled to any damages or other relief by reason thereof.
18. FURTHER DOCUMENTATION: If Sponsor shall desire to secure additional assignments or certificates of engagement for the entry or other documents, as Sponsor may reasonably require in order to effectuate the purposes and intents of these Official Rules, then each entrant agrees to sign the same upon Sponsor’s request thereof.
19. WINNERS’ LIST: Winners’ List requests will only be accepted after the Contest has ended. I, _______________________, declare that I am over eighteen (18) years of age and that I appear in or contributed to (or that my minor child appeared in or contributed to) the photo entry submitted by __________________________ in the Dunkin’ Donuts Chance for StarDDom Contest” (the “Entry”). I hereby irrevocably consent to the use of my name, actions and/or image (“Likeness”) in any form, as incorporated in the Entry, by Dunkin’ Brands, Inc. (“Sponsor”) and its affiliates, successors or licensees and others acting on its behalf (the “Released Parties”) for the purpose of advertising the Contest in any media, throughout the world in perpetuity, including but not limited to on the world wide web. If I contributed to creating the Entry in any manner, I hereby irrevocably consent to Sponsor’s use as set forth above and as described in the Official Rules.
I hereby grant Sponsor an irrevocable, fully paid, non-exclusive and unrestricted license to display and use my Likeness as Sponsor determines now and in the future, and to publish, adapt, edit and/or modify the Entry in any way, in whole or in part, and to use such Entry in commerce and in any and all media now known or hereafter discovered, worldwide, including but not limited to the Contest Application, without limitation or compensation to participant and without right of notice, review, or approval of any such use of the Entry or Likeness. I hereby waive and release Sponsor from any claims based upon invasion of privacy, right of publicity, defamation, or claim of visual or audio alteration or faulty mechanical reproduction.
No promise or representations of any kind have been made to me. This Release has been fully reviewed by the undersigned and is entered into as the date set forth below.
