I have been in with just my mug and said refill and they only charged me 50 cents when I paid in cash. So that part you can count on... I had one of my office buddies tell me to bring in the card to get the free refill. As far as the health thing from what I can see that the filling nozzle is high enough off the counter that the person filling the coffee can keep it from touching the dispenser. Just to give you an example, if I wanted a refill at a fast food restaurant it would be a health violation according to what you say because I took it and used it and brought it back for a refill. So I don't think that would fly with most people if they were refused a refill. Most places just ask you to take the top and/or the straw and then refill your cup and hand it back.
At this point I'll leave it with a caveat of "your results may vary"...
