    QUESTION Kuhn's ~ Pricing Errors at Kuhn's

    Does anyone know if there is a law in Pennsylvania that addresses stores that mis-ring customers? I do not shop at Kuhn's often but, in my handful of trips this year, I have been overcharged 3 times (that I know of!). Each time I have pointed it out and, each time, the cashier changed the price to the correct sale price after verifying signs. However, not one time did I even receive an apology. I really only go to Kuhn's now for a few things at a time that I know to be on sale so that I will know exactly what my total should be. Has anyone else experienced this?

    I just had this happen again this evening but there was a problem as the item was B1G1. According to past experience, it should have been half price but the woman doing the price check very rudely insisted I needed to purchase 2...

    Sorry it took me so long to reply.
    It stinks that you had items ring up wrong PLUS horrible customer service!
    I personally do not know of a state law regarding items that ring up wrong... but I did find the information for Kuhn's Main Office. Kuhn's Online

    I would direct all mis-rung items and customer service issues to them!

    I hope this helps and you have a better shopping experience in the future.

    As a former legal secretary, I got a little intrigued about your question. A report by the Federal Trade Commission HERE indicates that many states have been active in the area of pricing accuracy. Generally, weights and measures officials have authority to check the accuracy of prices in stores and can impose fines for violations of the state weights and measures act.

    The state Attorneys General may bring actions based on the state's consumer protection act or business and professions act. In addition, city and county attorneys often bring actions pursuant to state and local laws prohibiting price misrepresentations.

    With that said I found two places for you to start should you wish to pursue this. . .

    1) The Pennsylvania Food Merchants Association. They have a voluntarily "Scanning Certification Program," which merchants can join that is recognized by the Pennsylvania Department of Agriculture. Click HERE to jump to the section of their website that addresses this issue. There (to the right of the screen) you will find a telephone number. I bet they know the local laws well.

    2) The Pennsylvania Department of Agriculture should be able to answer your questions. Click HERE for their contact information. As stated above, "Weights and Measures" officials usually handle these type problems and there is a "weights and measures" complaint form at this link as well.

    I am in WA state and only know the law here. I did live in PA briefly but have only done POS work in WA. Here, such a discrepancy should fall under the Department of Weights and Measures. Give them a call and have them check the store out. Yes, there are going to be mistakes made. That's a given. But if the same store keeps making mistakes, it needs to be brought to their attention and they need to be audited.
