    By the way....Kmart has been the worst that I've encountered. Meijer makes a note of the error and usually takes steps to correct it right away. A couple of years ago, we purchased sunscreen at Kmart. It was mismarked $4.99 when it should have been $8.99. I told someone and they couldn't have cared less. So I bought two bottles, paid then went to customer service. Had to show them my pocket sized law, then they gave me the money back. I went back the next four days in a row and they had still not done anything about it. This law was put in place to keep stores on their toes when programming their scanners.

    Ugh....just another reason why I don't shop at Kmart. I gave them the chance when they did the doubling, 2 times ago.....everything was so seriously overpriced.....I thought "wait, kmart is supposed to be one of the cheaper type stores, thats what I always thought..." It was so bad/not worth the drive there, that I didn't even (and wouldn't even) go there for their next doubling event. I can get better deals at much nicer stores (I mean really the kmarts around here are DUMPS), even without doubling!

    Seriously....never going there again.

    I see your point, and yes, a store shouldn't have to honor amisplaced tag if it's put there by another customer.
    However, if it's an employee mistake then one of two things should happen. They should offer to compromise OR sell the item at the $1.99 price and take the difference from the employee who made the mistake.
    When I worked as a cashier and my drawer was short, I had to make up the difference.
    Also, I've seen stores w/ 90% clearance so it's not unheard of.

    I have so many problems at kmart they are no longer worth my time. And there rules change daily .

    If it was a legitimate mistake, ie 1 out of 20 identical binders was mis-marked, they do not have to honor the price. If they have 20 identical binders that were ALL marked $1.99 that is a different story.

    It does not actually fall into the category of bait & switch because they have to be advertising that binder at the discounted price to bait you into the store & when they try to charge you more or require non-advertised additional conditions (ie $1.99 w/ additional purchase) that is were the switch comes into play.

    This sounds like the case of someone made an oopsie. It happens…

    It's a gray area.

    Here's a copy of the new law, in effect on Thursday:
    AG - Michigan's New Scanner Law, The 2011 Shopping Reform and Modernization Act

    It is technically NOT illegal for them to refuse to sell it to you. IF they do, you are then entitled to a refund of the difference provided the transaction is COMPLETE and you have paid the full price, but ONLY if the price it's marked is "reasonable" for the item. For example, a $2.99 notebook marked at $1.99. I would not consider this a reasonable difference and would not have honored it, either, and that's as a retail employee as well.

    You're probably perfectly honest. But I've watched customers switch tags on Case It binders with the regular binders and then argue with me about the Michigan pricing law. Sometimes it seems there are more scammers than honest customers, and every time I've been in a K-Mart I've seen thieves and once saw a large shoplifting ring do their thing. (Well, they tried. As a customer, I didn't have to worry about a complaint to corporate and helped the store out. I've been there.)
