Fountain-Falling Texter Cathy Cruz Marrero Says 'Don't Text and Shop' - ABC News


A Pennsylvania woman's fall into a shopping mall fountain as she text messaged while walking has taken on a life of its own after video of the incident went viral online.

Video of Cathy Cruz Marrero's fall has attracted more than a million and a half views on YouTube and been shared widely on Facebook and Twitter.

But while the world has found her fall funny, Marrero said she finds little humor in the incident because no one from the mall has reached out to her.

"I didn't get an apology, what I got was, 'At least nobody knows it was you,' " Marrero said in an interview on "Good Morning America" today. "But I knew it was me."

Marrero didn't realize what happened until she was already in the water.

"Unfortunately, I didn't have anything to grab onto and hold my balance," she said.


Marrero was replying to a text from a friend from her church.

Marrero said she rarely sends text messages but this time she decided to text her friend back.

"I never text and walk at the same time," she said. "I don't like talking and walking on the phone, either."

Captured by security cameras, the video shows Marrero texting while walking and falling head first into the mall fountain.

She then casually gets up, fishes out her cell phone, climbs out, looks around and walks away.

Marrero said she embarrassed after the incident.

"I was like, 'I'm hoping nobody saw me. So let me just walk away,'" she said.

A woman checked on Marrero after the fall but no one from mall security followed up, she said.

She said they arrived 20 minutes after she left.

Fountain Fall Goes Viral
Marrero, who works at a store in the Berkshire mall in Wyomissing, admitted that she laughed, too, at first. But after being laughed at by millions, she said, no one has taken her feelings into consideration.

She learned that her fall went viral from her nephew, who called to tell her it was on YouTube.

"Nobody called ... 'Are you ok?'" she said. "It shows in the video nobody went to my aid.”

Marrero's husband, Walter, said security officials should have helped her.

"They should have responded to that immediately; they didn't know if she got hurt," he said.

Cathy Marrero agreed. "It could have been anybody's mother. It could have been a senior citizen falling ... and would they have gotten the same treatment as I did?"

On the raw video, voices can be heard discussing her fall: "Oh, my God, play it back, play it back."

At one point the tape is played back and viewed from a different camera.

Marrero believes the voices are mall security employees.


An official with Allied Properties, the company that owns the mall, told WFMZ that the posting of the video is under investigation.

In the meantime, Marrero has hired a lawyer to explore whether someone should have come to her aid rather than posting her image on the Internet.

Her lawyer, James Polyak, said they intend to hold the responsible parties accountable; whether requesting or demanding an apology and requesting an explanation on why this happened and how it happened.

Polyak plans to search for the identities of those responsible for making the video public.

Polyak suspects an official within the mall's security office viewed the footage and allowed it to be videotaped onto a cell phone.

Marrero said she has learned a lesson and has some words of advice for the younger generation.

"Do not text and walk ...," she said. "The fountain could have been empty. ... I could have walked into a bus, you know. ...I could have got hit by a car. It can happen anywhere ... anywhere.”

This really irks me - although I agree they should have not made security video’s public - but, wft is she suing for? No one helped her? She got up and walked away! And she’s upset the world is laughing at her expense….well don’t text and walk because obviously you can’t do both (not that I could either ).

I don't think she could even sue the company that released the video. IMO you really don't have any expectation of privacy in the middle of the mall.

They dont even know if it was the security video that was released onto youtube. Most phones nowadays have video capturing capabilities. Pretty much how half the things get caught on video! I dont know how you could be that into texting someone to not see that huge wall there and actually trip over something thats the height of your knees! If im walking and texting at the same time i periodically look up from time to time so i dont run into something! I think she is just embrassed that its now all over youtube. Now she has her 15 min of fame its just not the kinda fame she really wants. I prob would have chuckled seeing that myself. But then asked if she was alright.

I think it is freaking hillarious!! My Dh played it for me a few days ago!! I am sure she is embarrassed who wouldn't be let it be a lesson for people, Now that's why there are laws no texting and driving!! See you can't walk and text you definity shouldn't drive and text. So I just hope some one don't lose their job, I think in the end that is what she hopes for is to hold the person responsible for her humulation. Oh well what if it wasn't the security camera and it was like pp said just joe blow with a video cell phone, it's still funny I don't care who you are that's funny!

That is it exactly CouponQueen - she wants someone else to pay for her oopsie…

She is the one making it bigger than it needed to be though - Its not like the average person is going to look at that video and say ‘oh wait, I know her!’ I can barely see her phone more or less her face!!

Seriously we all know when you are humiliated, upset that the world is laughing at you, (although they do not know it is you) the next best step is to go public and confirm it is you plus tack a lawsuit on to further cement how ridiculous you are….

She admitted it was funny, but then complains that people are laughing at her….um…

And of course it could have been ‘insert tragic victim here’ so we shouldn’t laugh because security didn’t come running and obviously wouldn’t for anyone else either…. YOU GOT UP AND WALKED AWAY!!! That to me is a key indication you were and are in fact unharmed -why do they need to come running???

I’ll be extremely disappointed in our judicial system if they determine this case holds merit….
