    The executor cannot deposit into their account they can deposit into the estate's account, which they would need to be named. Also there are instances, as you mentioned, where a probate acct isn't necessary and you can deposit directly to a deceased's acct - but it is admittedly in most cases not the 'proper' way to do it.

    My grandfather never had my grandmother's "estate" go through probate. I know he had what little SS money that came to her stopped but he never even took her name off the bank account or the checks...8 years later...her name was still there.

    I wouldn't be surprised in the least when your dealing with a surviving spouse...some things just get done without going through probate.

    Now once he died...that was a whole different story. And I know my Dad and siblings were so appreciative that they got to deal with probate for both parents *add sarcasm*.

    That's not at all how the policy read at Wells when I worked there from 2003-2007.

    You mean to tell me that an executor could deposit a deceased's check into the executor's personal account?? I am under the impression it can only go into the estate's account….

    It depends on the relationship between the two, the will (or lack thereof), and the amount of the estate.

    With the elderly, there are a lot of cases where the finances have been handled by someone else for a long time before the death. My grandma and her oldest had a joint account because she was no longer of sound enough mind to pay the bills, balance the checkbook, handle the finances in general. So, if the child/spouse could deposit such checks while they were living, it could be done after they were gone.

    My mom took pains to make my dad legally her heir. I'm fuzzy on all the details now, but the way it worked was that when she died everything was his, and then we three were his heirs and it was divided. My dad died the day he signed the life insurance paperwork from my mom's death. If the papers had come the day after he died, we would have had to probate it because we{the kids}were my dads heirs not my moms....As it was nothing had to be done but deposit the check..
