it doesn't matter if he intended to kill him or not though..basically falls under similar situations as the DUI driver that kills someone...he didn't intend to kill anyone either...but he acted recklessly...so did the CVS manager by choking someone...he had no business or authority to choke.

I'm certainly no lawyer, so I could be wrong here, but I believe you do NOT have the right to put your hands on another human being unless you are A: A cop, or B: feel your life or safety, or someone else's life, is in immediate danger. Even then, your leeway for deadly force is limited.
Even though it was an accident, if you're going to play "hero" and try to hold a petty thief down til the police arrive, you better make DARN sure you're not injuring him/her in the process. That's where your rights end, IMO.
Now if this thief was pointing a weapon at you and threatening to kill you, then all bets are off and you do what you need to do to survive.
This wasn't the case here. Theft is a big problem, but it's certainly not worth killing someone over and risking ending up in jail.

This is the part I don't understand. I haven't heard anything about the thief threatening anyone in the store or having any weapons.
So why would the manager run after him? He had no idea what this guy could do, no idea if he had a gun or a knife, etc etc. What this guy did didn't hurt anyone except maybe CVS' bottom line. That said, the manager went over the line. He is the one who made it a physical altercation and put everyone in the vicinity in danger.

i am not for sure if you are trying to argue that point with me or not??? i agree with that and that is what i have been trying to say......he did not intend to do it but he should of known and acted recklessly....but that is up to the states' attorney to decide if it qualifies for reckless homicide..which it sounds like they have been working on and finally have said they might seek charges
