Freaking insurance company

I know some of you read my first vent in January about my car accident, In January some f****** idiot slammed in to me from the back while I was at a red light. This b**** took of running and left her passenger, I think the only reason why she didn't run to was because she broke her knee. I was so scared shocked in pain that I didn't think of getting the witnesses numbers(there was 2 nice men that got off to check on me) I stayed in my jeep till paramedics got there, I didn't even know what had hit me or who.
20 minutes after they put me in the ambulance that's when I found out that she had ran, the officer that was there didn't talk to me didn't ask me any questions, the only thing he said to me is please sign this paper(so they could tow my jeep) and said something about making the passenger talk to see where friend(the one that ran) might be.
Well this b**** has not been arrested, the first officer that showed up at the scene transferred my case to another officer and he let me know that she was not arrested and that he had a picture of her but since I can't identify her(because I didn't see her) there's nothing he can do I can't press charges. The only way is to get her to confess, and idiot me I forgot to ask can't he call her show up at her place and question her or her passenger. I mean really isn't that something he should do, and just trying to get ahold of him takes days.
The insurance that this b**** has is actually covering for her, at first they said that the car didn't belong to her that it wasn't under her name, then they said yes the car is hers now they are saying that they can't cover for anything because she doesn't stay at the address that's on her policy :shrug7: WTF!!!! can they do that can they get away from not paying anything. From what the first lawyer said was that her insurance is one of the biggest companies there is, that they will say and do anything not to pay.
It's not right this pece of s*** left us in a bad situation I have no car nothing has been resolved and who knows when it will be, has anybody gone through something like this, I don't know what else to do..

First, your insurance company will go after her insurance. If you are hit from behind, it is automatically no fault for you. You should not have to worry about anything about the other person. Not sure where you live but in MA we would escalate this to the Attorney General or Insurance Commissioner since it is unfair and you cannot resolve this. Please don't worry about the other person, that is not up to you. You need to push your insurance company to resolve your claim, let them worry about recouping their monies from the other parties....HTH Lisa

My insurance said that I had to go through her insurance, and they are only paying up to $2,500 and for some reason they just sent me checks for some of the hospital bills. IDK but shouldn't they mail out the payments to the hospital and not send them to me(nationwide sucks that's another vent) I have been called them but still waiting for a call back.

Many insurance companies just send you checks, I have Progressive and that's what they did as well.

What state are you in? Laws vary from state to state. I'm in Florida, which is a no-fault state, so your own insurance company pays for your damages no matter who is at fault. It doesn't sound like your state is the same if your insurance company is telling you to go through hers. Still, you pay your premiums for Nationwide to be "on your side" when something like this happens. They should be negotiating with her insur. co on your behalf.

Wow - I never heard of an insurance saying you can't submit a claim. I'd be shopping for new insurance - cause that is what you pay them for!

Do not cash any checks or anything! That is acceptance of their terms! I'd get back in touch with the lawyer and file a civil suit if necessary for your damages - you don't always have to prove guilt beyond reasonable doubt in civil suit. I'd also contact the AG and whoever else - because this is a bunch of crud!

I'm in Houston, TX and I also have home insurance with them but believe me I'm already looking into other companies.

First of all, I would consult a lawyer..Pronto! Second, I would file a claim with my insurance company and hers, if they would allow it!
