BLUSH $1,100.00 SOL Thanks to Paypal

OMG!! Story starts out by my DH selling gold coins on Ebay. Mind you he does not except Credit Cards. He sells a coin, gets paid and ships the coin overseas. A week or two passes and he gets contacted by paypal saying the buyer is disputing because he never received the coin. Luckily enough my DH has kept every corespondance and the mail receipt for the shipping. So he faxes all corespondance of everything he has to paypal and everything seems fine, he has the proof it got there. Pyapal claims it will take until Nov. sometime to get reimbursed. This is back in Sept. when this all took place.

Well today he got an email from paypal saying he is SOL. The person overseas had a stolen CC from someone in CA. Come to find out it was the person in CA disputing the charges and not the overseas guy. DH is not protected because it was paid for by CC and there is no signature on the other end, thats what they told him today on the phone.

The whole thing is is that DH doesn't except CC's, but Paypal excepts CC's and thats their way of collecting money.

WTF> Where is the protection on our end. Paypal should be the one eating the money they took the CC from the guy not DH. It seems that the buyers are protected but not the sellers.

This is just BULL****. I will never ever sell anything again on Ebay and you can bet I'll be taking every penney I have out of Paypal, and beleive there is quit a bit in there.

So all said and done. We are out a gold coin ( worth $1,100. or more) the overseas guy has his coin and the guy in CA pays nothing. Which I agree he shouldn't but why are we on the short end, we DON"T take CC's.:hectic1: Paypla shoul dbe out the money, they are the ones who excepted it, stolen or not. :hectic1::hectic1::hectic1:

I am sorry that happened. I think the out of the country transaction is where this all went out of control. I can not repeat paypals terms but there is not much of any protection built in for overseas transactions at all.
When we sold a lot on PayPal we would never accept international payment over a hundred bucks. They were made to pay by international money order.
You can build that into your auctions but if your husband stops taking paypal you will most likely suffer more of a loss than $1,100.

Hope the karma police get after this one.

Whether the buyer funded his payment with a CC or a bank account, the seller is still required to follow certain requirements if he wants to maintain coverage against claims. That means getting a signature on delivery for certain dollar amounts, etc. Before using ANY service, you should read, reread, read again, then ask questions about the service's terms to ensure you are protected.

The potential saving grace here is that the PayPal user agreement specifies that if the claim is for unauthorized payment (as it appears to be based on the OP), then mere proof of shipment (not the tougher standard of delivery) to the recipient address as listed on the transaction details page is sufficient as a defense to qualify for seller protection (assuming other criteria are met as well). It may be useful to call PayPal back and clarify exactly why the coverage is being denied given you do have proof of shipment.

He did call them today after getting the email stating he wasn't getting reimbursed. He does have proof that it was mailed to the destination, but the whole thing here is that the guy who purchased it is comminting fraud. Its not his C.C. It got delivered to where it was suppose to get delivered.

He has argued the point that he doesn't except CC's but PP took it as a form of payment. If Dh doesn't take CC this jerk would not have been able to commit fraud and we be out 1,000. Where is the protection, we delivered our end, and we are getting screwed :hectic1::hectic1::hectic1: .

He does take CCs if he accepts PayPal for an ebay sale. That's the point. Even if the fake buyer had used the real account-holder's bank account, your DH would still be on the hook.

Sellers using ebay and paypal CANNOT forbid CC-funded payments. It's been like that for at least 2 years. You've been lucky so far not to run into any problems. Before you sell anything else, PLEASE for your own sake go read the PayPal UA. I will also refer you to FW's online auctions forum. There's a great FAQ there about how to safely sell and stay within the terms of the PayPal and ebay UAs, and a strong group of experienced sellers and buyers who can help you protect yourself against loss.

The ONY way to win in this situation is to argue with PayPal that the UA says that proof of delivery is sufficient to win a seller's claim for coverage when the reversal is due to a claim of unauthorized account use. You have that, so check with PayPal and find out why the claim is being denied. There could be another requirement you missed. I can dig out the entire criteria list and we can go through each part to see if you should qualify, but it may be more instrumental for you or your DH to go over that with PayPal directly.

We don't have delivery confirmation, it was express mail. We do have the postal receipt for it going overseas and after all this started he did call the PO and they checked it out and said that it did get delivered 6 days after mailing. thats the only proof we have.

I personally have not sold anything on Ebay for probably 2 years or better and Dh just a few things here and there in the last few years. All I know is that neither him or I had it set up to where we take CC's but I guess thats all inmaterial now as you stated per the last 2 years.

Another thing, you said that your DH got paid before he shipped. If he has the money how can he be out? You mentioned that you have a good bit of money in your Paypal account. That is never a smart thing to do because they can go in and take it back out in case of a dispute. If it is not in there, they can not just take it back out.

Never leave large amounts of money in a paypal acount.Rule #1 if paypal puts it in there they can take it out.Thats why you take it out as :whatsfree4me said. I never leave over 10.00 in my pp account.

He doesn't have the money, they took it out of his account before he did.

Like I said I have not sold for about 2 years so I'm not worried about a dispute at this point. I am just pissed over this deal I will be taking my money out. I kept everything in there that I sold because back a year and a half ago or so it was paying 6-7% interest. I was getting $60-$70 in interest a month, now I'm lucky to get 3 bucks so I guess its time to get out of there. Was wanting to anyways and never did now I have a good reason to pull it.
