Does the insurance of the tree guys cover this? A tree falling and squashing a swing set is an "act of God" but a tree being taken down and falling on something is not.

The ice storm of December 2008 was a terrible event.
We could not live in my house for 2 weeks. We had to live at the Holiday Inn. They were so accomodating. Everyone please give patronage to them. We are still suffering the turmoil of this storm.
My yard was so badly damaged. As of right now, we have the front cleaned and just started the back. My trees had so much damage, we had to hire someone in to take them all down.
As many of you know money is so tight right now.
My brother gave my son the swing set his kids grew out of.
Yesterday when the crew was taking down one tree, their truck got stuck, but since the tree was already cut, they could not stop. If they had the tree may have fallen on our house.
We moved the swing set into what we thought was going to be a tree free zone. This one tree had a mind of it's own. It was kind of weird the way it fell. It fell as if it only wanted to kill the swingset.
Needless to say the swingset is now firewood. My son who is 4 is devistated. We are hoping the economy turns around and by the time the yard is ready we can get him a new one.
I ask for everyone's prayers.. My son is slightly autistic and really enjoyed this swingset, pray we will be able to get him a new one soon.

That is to bad. We were out of the house around week because of the storm but didnt have much damage.
These guys shoulda been insured/bonded and this would, I would think, be covered......
My husband & I own a tree service business & whoever did the work as mentioned above should have a license & also insurance to cover. I would not pay them until you get all insurance info from them & contacted the company. If they do not carry insurance then there should still be steps you should be able to take to get this
damage covered.
1st rule of thumb is to never hire anyone who is not licensed & insured.

The tree falling should be covered by insurance of the contractor hired to take down the trees, becuase they took down the tree that hit the swingset. Never hire anyone that is not liscenced and insured. I'm sorry you have to deal with all of this still after the fact.
For a new swingset look around for people getting rid of one through classified ads, freecycle, ect. since buying one new doesn't seem to be an option right now. I know in your area with all the damage most people will have probably been damaged.
Thank you all, yes they are liscensed and insured, but my conscience will not let them buy a new set, I bought this set brand new for my niece and nephew around 12 years ago, they used it and loved it. They grew and my brother brought it to my house since it was still in fairly good shape.
My son used it and loved it but we got it for free and I can not make them buy me a new one.
I will buy him a piggy bank and he can start saving for a new one.
We will have a yard sale and he can keep all the proceeds for his new swingset.

We too were in middle of the ice storm in Jan of this year.
It was horrible. I will pray for your son and swingset situation. I too
have a little boy although has not been diagnosed with autism, does
have some significant social issues. He becomes very fixated/attached
consumed with certain things and nothing will calm him down except
for whatever it is that he wants.
By all means post on freecycle and craigslist. Somebody somewhere will
have a swingset for you.
