    It's a good thing for you that you didn't sign it. In IL, if they cut your wages by a certain percent you can quit and still draw unemployment. Along with that, they will pay for you to go to school for I think 2 years.
    I quit my waitressing job 2 years ago in February. Before I quit the restaurant started having financial trouble. They asked a couple of us if we would start working for cash only. I told them I was sorry but I couldn't. I was 8 months pregnant when they asked me and I knew as soon as I went off the books it meant that I wasn't covered if I fell at work. They were upset, but I had to think of myself first. You did the right thing buy not just giving in to whatever they asked you to do, especially taking a paycut like that.

    in july the federal MINIMUM wage for tipped staff is going to be $3.75 or $4 (saw a sign at my work and can't recall for sure)something so i don't know how in the world your current capped rate can only be $3.75. Definately seek legal advice on this.

So like I said, you really need to make sure that your hourly + tips is equal to the federal minimum wage. It goes up to 7.25/hr on July 24,2009. If you can document proof that after this pay cut you are not making that much bring the to a lawyer ASAP. There are many lawyers out there that will sue the pants off of your employer and only take money from your judgement, meaning no actual OOP for you. Good luck with everything!

    p.s. Even if you are *really* bored, do not fill out apps at your workplace. That does not bode well for a good reference for you.

    Hi,
    I have such compassion for you. You gave your best, & are now being treated quite shabbily.
    It's exhausting to cry yourself to sleep, those times are markers in our lives. We never forget those times, but when we look back, we think--"look how far I've come."

    I really do believe this is a hidden opportunity for you to prosper, & be happier than ever. More stable companies keep good people, & don't change the rules on a daily basis.
    Tread gingerly....your "non-compliant" though healthy standing up for your self may make them want to watch your every move.

    Bosses who are mad & retaliatory do all sorts of weird things, & can even get other employees to bad mouth you (because they are in fear of their jobs) & try to say you weren't doing your job, & fire you so they don't have to pay the unemployment fee.

    I am all for legal counsel. Get out of there QUICK!! If the Boss has no integrity, He/She may definitely do something wrong, knowing it will take time & energy for you to pursue it.
    You would win, of course. But, first count the cost of how much time, money & energy it would take to fight it. If you have all three then--GO FOR IT!

    If not, ask Boss for 2 weeks to think about it--politely. This might buy You some time while job hunting.
    I am NOT saying to let them walk all over you! Just be SUPER careful if they are untrustworthy people.
    Start Documenting EVERYTHING the Boss says to you, time of day, who was present, etc. More details, the better.

    PLMK-In a couple of months, you not only will have a new job, but new friends on the job as well & ......probably better Bosses!
    If Boss hostile- your response will either diffuse it , or put gasoline on it.
    I have been some real sticky situations like yours. It was less hostile when I attempted to difuse it-while standing my ground.
