    Default questions about childsupport check garnishments

    To make it short my x would not pay the childsupport to me like we agreed on(yes there is a court order but he was to pay it to me). Each week it was some different reason why he could not pay it to me(lol one week he had to pay his dish network bill) so I went to the DA office and asked for help..I told him I was going to and he laughed at me and so on then said go ahead...

    He told me that they sent a letter saying that he had to the end of the month to get them a certin amount of money and was kind of making fun of me. He said that it said he could mail so much in weekly or all in at one time at the end of the month....I told him that was not what they told me. He wantted to know what they told me. I was told by the case worker that she was going to send garnishment papers to his job for the money to be took out of each pay check. I told him but if you got a letter saying whatever then I guess that is what you have to do I dont know.

    Now today he says that they sent a garnishment to his work and they are saying that if they send the papers into the main office they are going to let him go..can they do that? He said that they talked to him about this for more than 45 minutes this afternoon (I think that he is telling a out right lie about all this). Now he wants me to tell them to drop everything and he will pay me every week..(LOL sorry but I tired that one before buddy!) I told him that he needs to call the DA worker and tell her that he will bring them so and so in there every week and see what she has to say about it for its out of my hands now...I think this was one of the things the letter said he could do (from what he said) but this was the in oct when he was saying this and he has paid them NOTHING.

    I dont want him to lose his job for then I will get nothing but I have been getting nothing anyway so it dont make much differance for me.

    Anyone know if they can let him go over a childsupport garnishment for his check?

    No. Federal law prohibits this - he is feeding you a line of crap.

    Would he of been written up for anything else?

    I can ask the gals I know that know a lot about child support/garnishment. The only thing I can think of is this is like the final straw at work...but I'm betting he's just saying this to get you to back down..........................and if they fire him..he will collect unemployment..which your still entitled to the child support.

    One of the gals I know is an employer..so she knows the laws about this kind of stuff..I'll be back.

    This is what my friend that is an employer said (she's in michigan)

    NO it's not legit...at least not in MI as far as I know. I've had a few employees that had wages garnished for various things, and I couldn't fire them without work related cause

    He is feeding you a line of bull. An employer cannot fire an employee for having garnishments being taken out of a check.

    That is what I was thinking..I know he tells lies often..he forgets we were married 12 LONG years..

    I think he is just mad for now he has no choice but to pay it plus since he is behind they will be taking extra to catch it up. I dont know how they decide on how much extra to take but I bet its a % and since he has a much better paying job now it maybe a nice amount of extra at one time.

    I dont know if he has been wrote up at work or not for I try not to have to talk to him much. I dont like to talk to him.     If his employer actually has told him this, and they actually fire him, they he can sue him. Most employers are not stupid enough to actually tell them this. Is he working for a super small company?

    They don't have any choice but to follow the garnishment LOL...oh he sure is a winner. Man he will try and dodge it anyway won't he!

    its not a super small company but its not a large one either. I think the place he works at has like 100 people working there but they have two other places in that same town and some in other states...so when you add them all up its not a small company.

    Yes he is a winner!! LOL.. He very selfish and has a wife that is also. You know the the kind that has to keep up with the Jones well that is them..the package looks good but the box is full of crap...

    If they take 50 to 60% out of his check he will be really mad at me,like I care..I am thinking that is the problem more than anything, the amount they are going to be taking from his check that is..the regular amount of childsupport is no where near that amount of his check so they have lots of room to take the back pay he owes me out. I think he was hoping I would feel sorry for him if he told me that they were going to fire him over the garnishment so that way he would not be out that much money each week. I hope its not true(which I am 97% sure it ant) for I need the money and if they fire him I will still be getting none but he will have no check also.Yes he said they told him that if they send the garishment papers to the main office they will fire him..again I think he is telling a tale tho. I did tell him that if they fire him because of the garnishment he could sue them thats when he said something about them not hornoring garnishments..I did not reply to that but I was thinking if they dont hornor them then why would they tell you that they will fire you?

    They have NO rent/house payment, they live in a place that belongs to her grandmother. They both work and have good jobs so I dont feel sorry for them. They have not me over the past few months..Teens cost these days and one of them is in the 12th grade so that has been hard and cost me several dollars already this year(some of you know what I am saying there).

    LOL he'll be even more pissed when you get his tax return LOL....cause if you have gotten Office Child Support involved they will go after his tax return as well....
