May I ask who the other ins company is that your dealing with. I would call and ask to talk to a manager. The other thing you can do is have your attorney call them.
Six weeks ago I was in an auto accident where my car was totalled. I had a police report within a week that stated unequivocably that I was not at fault in any way and that the other driver received two tickets for actions causing the accident.
Long story short, we STILL have received no payment from the other insurance company, who refused to even pay for a rental. When I contacted the adjuster for the millionth time, she told me that I was considered 50% at fault until she determined otherwise. I asked what she was basing her determination on and why it was taking so long, she told me that she hadn't ordered a copy of the police report yet. It's been SIX WEEKS, and she hasn't even ordered it. It was available five days after the accident, and I had it within ten minutes of requesting it.
Other than filing a complaint with the insurance commissioner's office, what else can I do to motivate this heifer? We have an attorney, but are only being represented for personal injury. I've never dealt with this before - when I've been hit in the past, I had a check for damages within a day or two.

My sister's is asking who is the company.
she says you need to speak adjuster's supervisor. You can call the claim hotline and when you call that number you can ask for a supervisor right then and ask for a new adjuster. Also you can ask what fax number to fax the police report to. Explain to them what has been going on the adjuster, not providing you with a rental car is a no no....and refusing to get the police report is not acceptable.
The other thing you can do is file with your insurance company... who will pay you, and then will go after the other driver via subrogtion...but this will take a long time..and until they get the payment from the other driver it's a ding on your record. **so only do this if you have no other choice**
