I live in NY and we have to pay a .05 cent bottle deposit on soda cans, bottles, etc.
When I bought some Sobes this week, I had to pay the bottle deposit for each one, but on the bottle it just says: ME-HI-OR 5c CA CRV

Water was recently added to NY's container deposit, this includes flavored waters, but doesn't include sugar sweetened waters or sports drinks for example. Without having a Sobe infront of me to look at, I'm pretty sure that they're not to charge a deposit on this item. Now if it does fall under the deposit law, then it must say NY 5c on it. Take your receipt back and talk to CVS, they'll want to correct this, otherwise the state should be notified. It is unfortunate if this product is not subject to the deposit law, since it's an excellent recycling program, but everything didn't make it into the deposit program this round. Fortunately, water is finally covered! This is a great way for Boy Scouts, church, etc to collect recyclables and raise money.
10-11 states currently have deposit laws. They do require that their state be listed *on each container which is subject to the deposit* in some manner. CA does not list the amount (CA CRV), but all the others do.
States that don't give you the nickel back suffer from low recycling rates and probably see more bottles and cans laying along the road.
Sobe is NOT included in the new water deposit... Go back and demand your $ back! They are wrong to charge that! You will not get the 5c back if you try to redeem them.

I've battled this issue in MA with my beloved rocket fuel, aka Rockstar Roasted. Some stores charge the deposit and I have to point out that MA isn't listed on the can. Had to look up the law in my state, it's only on carbonated beverages and malt beverages. I wish we had a more expansive bottle law, like in Maine.
