The latest glitch....

So I spoke to our attorney this morning and I'm ready to pull my hair out. ARGH!!!

Here's the cliff notes history of our land!

in 1953, my grandparents purchased a large lot of land, 56 acres or thereabouts. There's about 5 acres on one side of the road and the rest is all on the other.

in the late 60's or early 70's (not sure which because I don't have a copy of that deed) they gave my parents a few acres and they built a house on it and that's where I grew up.

In 1984, my grandfather passed away.

In 1987, my grandmother sold the southern most parcel of land to our neighbor (13 acres or so)

In 1994, my grandmother had my fathers name put on the deed, for just in case.

In 2004, my grandmother sold the land to me and dh and is living in a nursing home.

So the latest glitch is that somewhere between 1953 and 1994, when they were retyping out the deed, they had some serious typos and one measurement went from the original 261.7' to 61.7 feet and another typo from 1287' to 128.7 feet. A huge difference in measurements, which has gone unnoticed until now. My dh and I never noticed it because we only had the 1994 deed to go by and it was wrong there. We only recently got the original original deed a few weeks ago. ARGH.

I don't think it's a major glitch. The attorney saw right away that it was a typo but he said it was up to the bank to determine if we will need to have a survey done, since we can't seem to find one that's ever been done on the land.


The lawyer also had said that he was under the impression that we would be putting the new house on the 4.9 acre lot, not the larger one where we are putting it. And because it's a smaller lot, that was what the bank had originally wanted the survey done for, to make sure we were well within the setbacks from the property lines (which by the way the town said they didn't need a measurement for because he's seen the lot and knows where the house will go in relation to where the existing house is). He's waiting to hear back from the bank to see what they say, but I'm guessing if we do need a survey done, that moves back our closing date a little (which still has not been determined yet)

And our builderdude is chomping at the bit here to get started digging the foundation and giving the modular company the go ahead to start building but we are not going to give him a deposit out of our pocket to get the house construction actually started if we're going to have a problem with having a place to put the house.

I cannot wait until we get this part finished!!!
and then I can move on to the impatience of waiting for the house to come in!!

wow, big typo there! I know house building is frustrating, but just think of all the pleasure afterwards!
