Leaky Roof.

Posted 02-27-2008 at 08:14:03 PM by BigDog
So here is my problem.
We owe WAY too much to everyone.

I thought we were looking close to out of debt. We paid off nearly $12,000 last year alone.

It FINALLY rained in GA. At least enough to let us know if our back door was still leaking. Now we moved into the house in Nov. 05. So the house is about 2 1/4 years old. The first year in our house. It rained like for the first time in January. Well from January till Nov. 06 we had them over here time after time to fix it from leaking. Long story short. I think I signed saying it was finished and fixed (not an owner to the house technically, not sure if that will help). Well, it is still leaking. We pulled off the base board last night next to the door and it is soaking wet. The carpet is moldy. So no laminate flooring for us. We really wanted it for our asthmatic son. So now what to do. We are going to seek an attorney to see if we have any legal ground to stand on. So they come back and fix it right.

So here is my estimations.

Whine mobile and student loan = $28,746.81
DD hospital visit = $500 left
DH hosptial visit = $3000
Attorney = $500
Backdoor if not paid by builder = $4000
-------------------------------------
Total = $36746.81

Is it me or did I really make Murphy mad when we decided it was time to get out of debt?

Sorry to hear about the home issues. We were the first to live in our home as well and moved in almost 8 yrs ago. I know our home warranty through the builder has certain limitations on their responsibility as far as what damages they would cover and for how long. You may want to look into your home warranty that you should have received when closing as well as documentation of all their visits. If the leakage has been there from the beginning and you have documentation on their failed repairs, I would think (and I am no lawyer) that they would be obligated to cover it.

Maybe if you make a big enough stink and write letters, throw the attorney in their face, and talk with the head of the company, they will be more than willing to pay for the repairs so as not to go to court and getting hassled further.
