OEM can mean different things. Sometimes it can mean it has been refurbished. Sometimes it means it is new but is out of the box.

In this case (I clicked on it for more details) it says:
Brand new sealed retail package! Item is listed as OEM because UPC bar code was carefully removed.

NOT used! NOT refurbished!!

1Yr warranty from Manufacturer!
It says the UPC was removed. You need it for the rebate. So, this wouldn't work.
